PROCLAMATION

The Palace, Valletta, Malta.
4th February, 2008.

H.E. the President of Malta, Dr. Edward Fenech Adami, acting on the advice of the Prime Minister Dr. Lawrence Gonzi, today issued the Proclamation dissolving the House of Representatives and calling for fresh general elections for the House, to be held on Saturday, 8th March, 2008.

PROCLAMATION
BY THE PRESIDENT OF MALTA

WHEREAS it is provided by subsection (1) of section 76 of the Constitution of Malta that the President of Malta may at any time by proclamation dissolve the Parliament of Malta;

AND WHEREAS it is provided by subsection (5) of section 76 of the Constitution of Malta that in the exercise of his aforesaid powers the President of Malta shall act in accordance with the advice of the Prime Minister;

AND WHEREAS I have been duly advised by the Prime Minister to dissolve Parliament from the 4th day of February, 2008;

NOW, THEREFORE, in exercise of the powers vested in me as aforesaid, I, EDWARD FENECH ADAMI, President of Malta, do hereby notify and proclaim that the Parliament of Malta be and is hereby dissolved from the 4th day of February, 2008.

WHEREAS section 77 of the Constitution of Malta provides that there shall be held a general election of members of the House of Representatives at such time within three months after every dissolution of Parliament as the Presidnet of Malta, acting on the advice of the Prime Minister, shall by proclamation appoint;

AND WHEREAS Parliament was dissolved on the 4th day of February, 2008;

AND WHEREAS I have been advised by the Prime Minister to appoint the 8th day of March, 2008 as the time when a general election shall be held;

NOW, THEREFORE, in exercise of the powers vested in me as aforesaid, I, EDWARD FENECH ADAMI, President of Malta, DO HEREBY NOTIFY AND PROCLAIM that I appoint the 8th day of March, 2008 as the time when there shall be held a general election of members of the House of Representatives.

PROCLAMATION
BY THE PRESIDENT OF MALTA

WHEREAS it is provided by subsection (3) of section 75 of the Constitution of Malta that the House of Representatives shall meet not later than two months after the publication of the official result of any general election by the Electoral Commission on a day appointed by the President;

AND WHEREAS the official result of the general election held on the 8th day of March, 2008, was published by the Electoral Commission on the 17th day of March, 2008;

AND WHEREAS it is provided by subsection (1) of section 75 of the Constitution of Malta that each session of Parliament shall commence at such time as the President may by proclamation appoint and shall be held at such place or places as the President by proclamation, or as the House of Representatives in any manner it may deem appropriate, may from time to time appoint;

NOW, THEREFORE, I, EDWARD FENECH ADAMI, PRESIDENT OF MALTA, DO HEREBY APPOINT the 10th day of May, 2008 at 10.45 a.m., to be the day and the time when the House shall meet and a session of Parliament shall commence, and the Hall of the House in the Palace,, Valletta, to be the place where such session shall be held.

The framework of the Maltese electoral system is defined in Chapter 4 of the Constitution of Malta, which states:

    "There shall be a Parliament of Malta which shall consist of the President and a House of Representatives."

  • General: Every Maltese citizen aged 18 or older has the right to vote, and every citizen aged 21 or older is eligible for election of Members to the Maltese Parliament. (The president, judges and senior public officials, as well as the Commander and high-ranking military officers, may not stand for election to the House, unless they have resigned their position at least 100 days before the elections.)

  • National: The entire country constitutes 13 electoral districts with the sister island of Gozo being the 13th electoral district.

  • Direct: The Maltese Parliament, is elected directly by the voters, not through a body of electors.

  • Equal: All votes cast are equal in weight.

  • Secret: Elections are by secret ballot.

  • Proportional: The 65-member House of Representatives' seats are assigned by the Proportional Representation system which elects five MPs from each electoral district. By virtue of Constitutional Amendment recently approved, this Legislature shall be composed of 69 Members of Parliament.
